Detectives Charge Three Suspects with Aggravated Burglary

Aggravated Burglary

San Juan County, NM - On February 21, 2014, at approximately 0034 hours, San Juan County Sheriff’s Deputies responded to a report of a fight and shots fired.  The incident occurred at a residence on County Road 4599 (Blanco, NM).

Upon arriving at on-scene, deputies made contact with two victims, Geraldine Atencio, and Sammy Sanchez, both residents of the home. The victims were able to identify the suspects involved in the incident as:

3 suspects

  • 58 year-old Danny Atencio,
  • 35 year-old Antoinette Gutierrez,
  • 36 year-old Christopher Gutierrez..

“The victims explained that prior to the incident, Atencio had been making threatening phone calls and text messages to Sanchez,” said SJC Detective Dave McCall.  According to Sanchez, he was asleep in bed when Atencio broke into the house. “Sanchez stated that Atencio came into his room and hit him in the head,” explained McCall.  “Atencio informed us that Gutierrez was also in the home and struck her in the head with a bat.”

At some point the altercation moved to the front porch of the home.  “Atencio stated that while she was struggling with Antoinette Gutierrez, Christopher Gutierrez pointed a machete at her and poked her with it, ” said McCall.  “She said that she grasped the machete and attempted to pull it away from Christopher.  He then dropped the machete, moved towards the suspect’s vehicle, and fired several rounds from a handgun.”

Soon after that all three suspects fled the residence in the vehicle they had arrived in.  Detectives quickly located Danny Atencio and Antoinette Gutierrez at a residence in Farmington, NM.  A search warrant was obtained on the home in Farmington.  “We left a deputy on-scene to ensure it stayed secure,” explained McCall.  “While I was preparing the search warrant Chris Gutierrez emerged from  underneath a couch in the living room and surrendered to Deputy William Ferrendelli.”

All three suspects were arrested without incident.  They were charged as follows:

 

  • Daniel Atencio:
    • Aggravated Burglary (2nd degree felony),
    • Aggravated battery (3rd degree felony),
    • Harboring or aiding a felon (4th degree felony), and
    • Tampering with Evidence (3rd degree felony).
  • Antoinette Gutierrez:
    • Aggravated Burglary (2nd degree felony),
    • Aggravated battery (3rd degree felony), and
    • Harboring or aiding a felon (4th degree felony).
  • Christopher Gutierrez:
    • Aggravated Burglary (2nd degree felony),
    • Aggravated Assault (4th degree felony),
    • Resisting, evading, or obstructing an officer (misdemeanor), and
    • Tampering with Evidence (3rd degree felony).
