San Juan County, NM – On 09/28/2011 at approximately 1212 hours San Juan County Sheriff’s Office Deputies were dispatched to a trailer park located on County Road 5099. They were responding to a report of a male subject shooting toward empty trailers in the area.
The suspect had been reported as last seen leaving the area at a high rate of speed in a green SUV. Upon arrival, Deputy Sandy Wagner contacted the victim, David DeHerrera (age 49 of Bloomfield). “Mr. DeHerrera reported that he and his stepbrother, had been engaged in verbal altercation inside one of the vacant trailers,” explained SJC Detective Candace Montoya. “Mr. DeHerrera informed us that at one point during the altercation his stepbrother began threatening him.” The stepbrother left the trailer and shortly after Mr. DeHerrera heard three gun shots.
“A 911 caller was able to inform dispatch that they had witnessed a male subject running west of the two trailers after the caller had heard a gunshot,” said Montoya. “This witness observed that male subject was holding a revolver handgun. The witness saw the suspect turn back toward the trailers and shoot in the direction of the trailers approximately two times. The suspect then got into a green SUV”.
At approximately 1404 hours, a male subject identified as Leroy Tapia (age 54 of Bloomfield), returned to the residence. Tapia admitted to engaging in a verbal altercation with Mr. DeHerrera and shooting at the trailer where he had left DeHerrera after the altercation. He also admitted to shooting at the trailer previously from the porch of his residence and he provided information that led to the location of the firearm.
Mr. Tapia is being booked at the San Juan County Detention Center on the following charges:
- Shooting at inhabited dwelling or occupied building (4th degree felony)
- Aggravated assault with a deadly weapon (4th degree felony)
- Tampering with evidence (4th degree felony)
- Negligent use of a firearm (petty misdemeanor)
