Deputies Arrest Two Individuals for Aggravated Burglary

San Juan County, NM - On Saturday July 6, 2013 at approximately 1504 hours, San Juan County Sheriff’s Deputies were dispatched to a residence on County Road 6070 in Fruitland, NM. The call was in reference to an armed subject.

“According to the reporting party, two armed males entered his home and threatened him with a gun,” explained Deputy David Eighme. “While we were en-route to the residence, dispatch advised us that the suspects had left the house and had apparently driven off in a pickup truck.”

Deputies continued to the residence and interviewed the victim. The victim stated that two males had entered his residence and threatened to ‘slit his throat and shoot him’. “The victim identified one of the suspects as Orlando Garcia,” explained SJC Sheriff’s Office Sergeant Devon Dollar. “He was also able to give us a description of the suspect’s vehicle.”

At approximately 1540 hours, officers from Farmington Police Department advised dispatch that a pickup matching the suspect vehicle description was northbound on New Mexico 170. Shortly after, a felony stop was conducted near the entrance to Jackson Lake.

The two male suspects were in the pickup and were later identified as Rusty Betts (age 31 of Farmington, NM) and Orlando Garcia (age 29 of Aztec, NM). Another adult male was also in the vehicle, he was not charged in the incident and was released. An eight year old male child was also found unharmed in the vehicle.Orlando Garcia

Upon further investigation, deputies were able to determine that Garcia and Betts had entered the victim’s residence unlawfully and did threaten him with a gun. “Apparently, Garcia was upset with the victim over an argument that had occurred between the victim and his girlfriend, who is related to Garcia,” explained Dollar. “According to the victim, the argument had occurred one month earlier and it had been resolved peacefully.”

Garcia and Betts were charged with:

  • Aggravated Burglary- 2nd Degree Felony
  • Aggravated Assault- 4th Degree Felony
  • Child Abuse- 3rd Degree Felony
  • Contributing to the delinquency of a minor – 4th Degree FelonyRusty Betts
  • Tampering with a motor vehicle – misdemeanor
  • Criminal Damage to Property (less than $1,000)- petty misdemeanor
