1st Degree Felony Charge(s)

~First degree felonies in New Mexico include murder, criminal sexual penetration of a minor and other serious sexual crimes, kidnapping, and robbery while armed with a deadly weapon.~

  • A first degree felony is punishable by up to eighteen years in prison and a fine up to $15,000 with the following exceptions:
    • aggravated criminal sexual penetration – up to life in prison and a fine up to $17,500
    • first degree felony resulting in the death of a child – up to life in prison and a fine up to $17,500.
