Ref: Update to the shooting incident that occurred Monday Jan 7, 2013. (See previous release from that date)
After reviewing the facts of the case with the District Attorney’s Office it was determined that William Wilson (the shooter in the incident) will not be charged for his role in the shooting. Based on the available information, he acted within reason in the defense of his self and/or others.
On the other hand, Tyson Mclemee (the shooting victim) was found to have committed the crimes of:
Aggravated battery (use of deadly weapon) (3 counts) 30-03-05(C). (a 3rd degree felony)
Aggravated Assault (use of a deadly weapon). 30-03-02(A). (a 4th degree felony)
Tampering with evidence (3rd or 4th degree felony) 30-22-05(A) & (B)(2). (a 4th degree felony)
Criminal damage to property (less than $1,000). 30-15-01. (a petty misdemeanor)
A warrant for the above charges was obtained and served on Mclemee. He was arrested on 1/16/2013 and booked into the San Juan County Detention Center on a $41,000 cash only bond. He is also being held on a no bond probation violation. He was originally on probation for possession of a controlled substance.
